The agreement between you and AP Trade Action. It covers what the software does, what it deliberately does not do, who is responsible for an order that reaches your broker, and how billing works.
In short: this is software you point at your own broker account. It is not advice, we are not a broker, we never hold your money, and every order placed on your account is yours.

AP Trade Action ("we", "us", "our") provides the trading journal, backtesting terminal and trading-agent desk available at aptradeaction.com and its subdomains (the "Service"). These Terms of Service (the "Terms") form a binding agreement between you and us, and apply every time you use the Service — including the free journal, a paid plan and a free trial.
By creating an account or using the Service you accept these Terms. If you do not accept them, do not use the Service. Our Privacy Policy is incorporated into these Terms by reference and explains what we do with your data.
The Service is sold and made available to traders internationally. It is your responsibility to ensure that using it, and trading the instruments you trade, is lawful where you are.
The Service is software. It records trades you have taken, analyses your own history, replays real price history so you can rehearse a strategy, and — on the plans that include it — connects to a trading agent that watches the market against rules you configure and can send orders to your own broker account on your instruction.
To be unambiguous about the things it is not:
You must be at least 18 years old and legally able to enter into a contract. You must be acting on your own behalf and for your own account, unless we have agreed otherwise in writing.
You may sign in with an email address and a one-time code, with Google, or with a password if you have set one. Keep your sign-in method and any device that stays signed in secure. You are responsible for everything done through your account, including by anyone you allow to use it.
One person, one account. Do not share an account, sell access to it, or use another person's account. Tell us promptly at support@aptradeaction.com if you believe your account has been accessed without your permission.
Information you give us when you register must be accurate, and you must keep it up to date.
Nothing the Service produces is financial product advice, investment advice, a recommendation, or an opinion that any instrument, strategy or trade is suitable for you. That includes alerts, agent decisions and reasoning, AI-written trade reviews, macro and news summaries, statistics, backtest results, position-size calculations and every number on every screen.
We do not hold an Australian financial services licence and we do not provide a service that requires one. We have not considered your objectives, financial situation or needs. Before acting on anything you see here, consider whether it is appropriate for you and obtain independent licensed advice if you need it.
Alerts and agent output are the arithmetic result of rules you configured, applied to price data. They are not a view about the market and carry no assurance of accuracy, profitability or fitness for your purpose.
Trading leveraged foreign exchange, metals and contracts for difference carries a high level of risk. You can lose more than you deposit. Leverage magnifies losses as readily as gains, and past performance — yours, a strategy's or a backtest's — is not a reliable indicator of future performance.
You accept that risk in full. You should not trade with money you cannot afford to lose, and you should not use the Service if you do not understand the instruments you are trading.
By default the Service alerts; it does not act. On the plans that include execution, an order reaches your broker in exactly two ways: a confirmation you tap, or an automatic mode you have switched on yourself for a specific account. Automatic mode stays off until you turn it on, and you can turn it off at any time.
Whichever way it happened, every order placed on your account is your order and your responsibility. You are responsible for the rules you configure, the risk and size settings you choose, the accounts you connect, the confirmations you give and the automatic modes you enable — and for monitoring the resulting positions with your broker.
Software, networks, data feeds and broker APIs fail. An alert may be late, duplicated or never arrive; an order may be rejected, partially filled, filled at a different price, or not sent at all; a connection may lapse without warning. The Service is not a substitute for watching your own account, and it is not a risk-management system of last resort. Your broker's platform, not this one, is the record of what you actually hold.
Do not rely on the Service to close a position, to enforce a stop, or to protect you from a loss. Stops and limits belong with your broker.
The Service works by connecting to things you already own: a cTrader broker account, a trading agent of your own, and — where AI features are used — your own model provider API key. You authorise us to connect to them on your behalf using the credentials or authorisations you provide, and only for the purposes described in these Terms and the Privacy Policy.
Those third-party services are governed by your agreements with them, not by us. We do not control them, we do not guarantee their availability or accuracy, and we are not responsible for what they do, charge or fail to do. You can revoke any connection at any time, from within the Service or from the provider — doing so will stop the features that depend on it.
AI features other than the trade importer run on your own model provider key, held by your trading agent. You are billed by that provider directly, at their prices, for your own usage. We do not mark it up and we cannot cap it — set your own limits with the provider.
Price history, live quotes, economic calendar entries and news reaching the Service come from third-party providers and are made available to you for your own personal analysis and trading only. They may be delayed, indicative, estimated or incomplete, and where a value is an estimate rather than a broker price the interface says so.
You must not redistribute, republish, resell, sublicense, scrape or systematically extract market data obtained through the Service, or make it available to any other person, whether or not for a fee. Some of our data licences require this, and it is a condition of your use.
Backtests, replays and simulator runs are hypothetical. They are produced by applying rules to historical price data after the fact, with the benefit of a complete record that no live trader has at the moment of the trade.
They do not account for everything that decides a real result — spread and slippage at the moment of the fill, commission and swap on your own account, latency, requotes, liquidity, gaps and weekend risk, or your own behaviour under pressure. A simulated result can differ materially from a live one, and frequently does.
No backtest, statistic or equity curve shown in the Service is a projection, a promise or a representation of what you will earn.
The trade journal, its analytics and its calendar are free and do not expire. Strategies, the backtest and replay terminal, live agents and the desk require a paid plan. Current prices, inclusions and limits are on the pricing page at aptradeaction.com/pricing, and form part of these Terms.
Payments are processed by Stripe. We do not see or store your full card number. By subscribing you authorise us, through Stripe, to charge your payment method on a recurring basis for the plan and billing period you chose, until you cancel.
You must not:
We may suspend or limit access immediately, without notice, where we reasonably believe conduct of this kind is occurring or where it threatens the Service or another user.
We do not promise that the Service will be available without interruption or error. It depends on infrastructure, brokers, data providers and model providers we do not control, and parts of it are deployed separately, so a feature can be unavailable while the rest works. The platform status shown in the interface is a measured probe, not a guarantee.
We may change, add or remove features, and may perform maintenance, at any time. Where a change materially reduces what a paid plan provides, we will tell you by email and you may cancel.
Support is provided at support@aptradeaction.com on a reasonable-endeavours basis. We do not offer a guaranteed response time.
The Service, its software, interface, branding and documentation are ours or our licensors'. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own trading for as long as these Terms apply. Nothing else is transferred.
Your data stays yours: your trades, journal entries, notes, rules, strategies, backtest sessions and uploads. You grant us only the licence we need to run the Service for you — to store, process, back up and display that content, and to transmit it to the third parties described in the Privacy Policy so the features you use can work. We do not use your content to train models, and we do not sell it.
If you send us feedback or a suggestion, we may use it without obligation to you.
You can stop using the Service at any time, cancel your subscription from the billing portal, and ask us to delete your account and its data by writing to support@aptradeaction.com.
We may suspend or terminate your access if you materially breach these Terms, if payment fails and is not corrected, if we are required to by law, or if we discontinue the Service. Except where a breach or the law makes it impractical, we will give you reasonable notice and a chance to export or retrieve your data.
Sections that by their nature should survive termination — including sections 4, 5, 6, 8, 9, 13, 15, 16, 17 and 20 — survive it.
To the maximum extent permitted by law, and subject to section 16, the Service and everything in it is provided "as is" and "as available". We exclude all warranties, conditions and representations not expressly stated in these Terms, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, availability or non-infringement.
We do not warrant that the Service will be uninterrupted, timely, secure or error-free; that data, alerts, statistics or AI output will be accurate, complete or current; or that using the Service will be profitable or will avoid a loss.
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. If you are a consumer in Australia, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
Where we are permitted to limit our liability for breach of a consumer guarantee, our liability is limited, at our option, to supplying the service again or paying the cost of having it supplied again.
If you are a consumer elsewhere — including in the European Union or the United Kingdom — you keep the mandatory consumer rights of the country you live in, and nothing in these Terms takes them away.
Subject to section 16, and to the maximum extent permitted by law, we are not liable for any trading loss, lost profit, lost opportunity, loss of anticipated saving, loss of data, business interruption, or any indirect, incidental, special, punitive or consequential loss, however caused, arising out of or in connection with the Service — including a missed, late, duplicated or erroneous alert, an order that was or was not sent, a broker or data provider failure, an outage, or reliance on any output of the Service.
Subject to section 16, and to the maximum extent permitted by law, our total aggregate liability arising out of or in connection with these Terms and the Service, whether in contract, tort (including negligence), statute or otherwise, is limited to the greater of the total fees you paid us in the twelve months before the event giving rise to the liability, or one hundred Australian dollars.
Nothing in these Terms limits liability that cannot be limited by law, including for fraud, or for death or personal injury caused by negligence.
You acknowledge that these limits are a reasonable allocation of risk given the price of the Service and the fact that we neither execute your trades nor control your account.
You indemnify us against any claim, loss, liability or cost (including reasonable legal costs) arising from your use of the Service in breach of these Terms or the law, from your trading, or from a claim by a third party — including your broker, prop firm or a data provider — relating to your use of the Service. This does not apply to the extent the claim arises from our own breach or negligence.
We may update these Terms. The current version is always at aptradeaction.com/terms, with the date it was last updated at the top.
For a material change, we will give you reasonable notice — by email or in the app — before it takes effect. Continuing to use the Service after it takes effect means you accept the updated Terms; if you do not, cancel your subscription and stop using the Service before then.
These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that place and the courts able to hear appeals from them.
If you are a consumer resident somewhere else, this does not deprive you of the protection of the mandatory laws of the country where you live, or of your right to bring proceedings there where the law gives you that right.
Before starting proceedings, please write to us at support@aptradeaction.com and give us a fair chance to resolve the problem.
These Terms, together with the Privacy Policy and the pricing page, are the entire agreement between us about the Service. If a provision is unenforceable, it is severed and the rest stands. A delay in enforcing a right is not a waiver of it. You may not assign these Terms; we may assign them to a successor to our business, on notice to you.
There is no third-party beneficiary to this agreement.
